MOBILE TERMS OF SERVICE (SMS/TEXT MESSAGING)

OVERVIEW

The ITFactory mobile message service (the "Service") is operated by ITFactory ("ITFactory", "we", or "us"). Your use of the Service constitutes your agreement to these Mobile Terms of Service ("Mobile Terms").

We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time, and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes.

CONSENT TO RECEIVE TEXT MESSAGES

By consenting to ITFactory's SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of ITFactory through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state, federal, or provincial Do Not Call list.

Text messages may be sent using an automatic telephone dialing system or other technology through our SMS provider, Klaviyo.

Types of Messages You May Receive:

  • Service-Related Messages: Order confirmations, shipping updates, delivery notifications, account alerts, password resets, and other transactional information
  • Promotional Messages: Special offers, promotions, sales announcements, new product alerts, cart reminders, and other marketing communications

VOLUNTARY PARTICIPATION

You understand that you do not have to sign up for this program in order to make any purchases from ITFactory. Your consent to receive text messages is not a condition of any purchase. Your participation in this program is completely voluntary.

MESSAGE FREQUENCY AND COSTS

We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider.

  • Message Frequency: Varies based on your activity and preferences. You may receive up to 10 messages per month for promotional content, plus additional transactional messages related to your orders.
  • Message and Data Rates: Standard message and data rates may apply as determined by your wireless carrier.
  • Your Responsibility: Check your mobile plan and contact your wireless provider for details about your text messaging plan. You are solely responsible for all charges related to SMS/text messages.

HOW TO OPT-OUT (STOP RECEIVING MESSAGES)

You may opt-out of the Service at any time. There are two ways to unsubscribe:

Method 1: Text STOP

Text the keyword STOP to 1(833)404-1409

You'll receive a one-time opt-out confirmation text message. No further messages will be sent to your mobile device, unless initiated by you.

Method 2: Click Unsubscribe Link

Click the unsubscribe link (where available) in any text message to cancel.

Note: If you have subscribed to other ITFactory mobile message programs and wish to cancel, except where applicable law requires otherwise, you will need to opt out separately from those programs by following the instructions provided in their respective mobile terms.

SUPPORTED CARRIERS

The Service is available on participating carriers including but not limited to:

  • AT&T
  • T-Mobile
  • Verizon
  • Sprint
  • Rogers (Canada)
  • Bell (Canada)
  • Telus (Canada)
  • Other major carriers

The wireless carriers supported by the Service are not liable for delayed or undelivered messages.

PHONE NUMBER CHANGES

We may change any short code or telephone number we use to operate the Service at any time and will notify you of these changes via text message or email.

You acknowledge that any messages, including any STOP or HELP requests, you send to a number we have changed may not be received, and we will not be responsible for honoring requests made to discontinued numbers.

If You Get a New Mobile Number: You will need to sign up for the program again with your new number. We cannot transfer your subscription to a new number automatically.

YOUR RESPONSIBILITIES

You agree to:

  • Provide us with a valid, working mobile phone number
  • Notify us if you change your mobile number
  • Ensure your device is capable of receiving text messages
  • Maintain an active mobile service plan
  • Update your mobile number in your account settings if it changes

LIMITATION OF LIABILITY

To the extent permitted by applicable law, you agree that we will not be liable for:

  • Failed, delayed, or misdirected delivery of any text messages
  • Any errors in text message content
  • Any action you may or may not take in reliance on text messages
  • Issues caused by your wireless carrier
  • Messages not received due to phone service interruptions
  • Messages filtered or blocked by your device or carrier

We make reasonable efforts to ensure timely delivery of messages, but we cannot guarantee delivery due to factors outside our control, including carrier delays, network congestion, or device issues.

PRIVACY AND DATA PROTECTION

We respect your right to privacy. We collect and use your mobile phone number and related information in accordance with our Privacy Policy.

What We Collect:

  • Mobile phone number
  • Opt-in/opt-out preferences
  • Message delivery status
  • Interaction with text messages (clicks, opens)

How We Use This Information:

  • To send you the messages you've requested
  • To improve our messaging service
  • To comply with legal requirements
  • To analyze the effectiveness of our campaigns

Quebec Law 25 Compliance: Your mobile phone number is considered personal information under Quebec privacy law. You have the right to access, correct, or request deletion of this information. Contact us at admin@itfactory.ca to exercise these rights.

COMPLIANCE WITH LAWS

Our SMS program complies with:

  • Canada's Anti-Spam Legislation (CASL)
  • U.S. Telephone Consumer Protection Act (TCPA)
  • Quebec Law 25
  • CAN-SPAM Act
  • CTIA Messaging Principles and Best Practices

PROHIBITED USES

You may not use the Service to:

  • Send spam or unsolicited messages to others
  • Share your subscription with others
  • Use the Service for any illegal purpose
  • Attempt to interfere with the Service
  • Reverse engineer or attempt to access our systems

MODIFICATIONS TO SERVICE

We reserve the right to:

  • Modify or discontinue the Service at any time
  • Change message frequency
  • Update these Mobile Terms
  • Change our SMS provider
  • Add or remove message types

We will make reasonable efforts to notify you of material changes to the Service.

DISPUTE RESOLUTION

Any disputes arising from the Service will be governed by the laws of the Province of Quebec and resolved in accordance with the dispute resolution provisions in our Terms and Conditions.
